Q: Does a municipality have the authority to negotiate a fee providing extra police protection to a private business or a quasi-governmental entity if both parties are agreeable?

A: A municipality has no authority to enter into an agreement to provide certain citizens, businesses or governmental entities greater police protection than others in return for compensation. (Attorney General’s Opinion to Sorrell dated May 22, 2009)
